The Commentary on the Treaty on the Functioning of the European Union (four volumes) is a major European project that aims to contribute to the development of ever closer conceptual and dogmatic standpoints with regard to the creation of “Europeanised research on Union law”. Following on from the Commentary on the Treaty on European Union, this book presents detailed explanations, article by article, of all the provisions of the TFEU, discussing the application of Union law in the national legal orders and its interpretation by the Court of Justice of the EU. The authors are academics and practitioners from all across Europe and different legal traditions, some from a constitutional law background, others experts in the field of international law and EU law. Reflecting the various approaches to European legal culture, this book promotes a system concept of European Union law toward more unity notwithstanding its rich diversity grounded in national traditions.

This book explores the sheer complexity of the SSM’s institutional design adopting an comprehensive approach to banking supervision. At its core, this work examines the tangible mechanisms of prudential regulation or supervision both at the European and national levels, offering a comparative analysis of ten national systems. Reflecting the results of an intensive, four-year research project that saw the collaboration of academics and practitioners, it addresses two interrelated issues. It investigates the efficacy of the shared national- and EU-level enforcement system the EU introduced in reaction to the financial and banking crisis.Secondly, it scrutinizes the role that criminal law can play in sanctioning the breaches to banking regulation.

This ground-breaking book brings clarity to the dynamically developing field of international tax law. It empowers individuals and corporate taxpayers to navigate their way around and helps tax authorities take taxpayers' rights into account from the beginning. The book is the result of several years of research conducted with the support of the International Law Association. Taxpayers in International Law puts taxpayers' rights on the global international tax agenda as the necessary counterweight and complement to Base Erosion and Profit Shifting (BEPS). Importantly, it pleads for a global minimum standard of legal protection of the fundamental rights of taxpayers and extracts the content of such rights from relevant constitutional principles of many countries around the world. The book is structured in 3 parts: Part I focusses on the legal sources and on the relations between taxation and international human rights law. Part II identifies general principles and specific taxpayers' rights, groups them into 3 categories (procedural, related to sanctions, and substantive), and analyses the different implications that arise in each of them. Part III features concrete proposals for establishing a global framework for the protection of taxpayers' rights, including guidelines for tax authorities. The book is a unique instrument for the daily work of practitioners and international tax scholars interested in securing the protection of taxpayer's fundamental rights, as well as for those involved in tax collection worldwide. Taxpayers can refer to the book to find out which rulings and concepts can help them enforce their rights; tax authorities and judges can use the book to verify which rights have to be respected.

This document sets out planning policies applicable throughout England, focusing on procedural aspects and the process of preparing local development documents. These should be taken into account by local planning authorities in the preparation of local development frameworks, and mineral and waste development frameworks. This document complements other national planning policies and should be read in conjunction with them. Also known as PPS 12, this document replaces Planning policy guidance note 12 on development plans (PPG 12, 1999 edition, ISBN 1851123490), except that PPG 12 will remain in operation for development plans still being prepared under the 1999 Development Plan Regulations.

Hearing is an intricate modality of sensory perception. It is continuously enfolded in the surroundings in which it takes place. While passive in its disposition, hearing is integral to the movement and fluctuations of one’s environment. At all times, hearing remains open, (in)active but attuned to the present and continuously immersed in the murmur of its background. A delicate perception that is always situated but fundamentally overarching and extended into the open. Hearing is an immanent modality of being in and with the world. Beyond the capacity of sensory perception, hearing is also the ultimate juridical act, a sense-making activity that adjudicates and informs the spatio-temporal acoustics of justice. This penultimate volume of ‘Law and the Senses’ gathers contributions from across different disciplines working on the relationship between law and hearing, the human vocalisations and non-human echolocations, the spatial and temporal conditions in which hearing takes place, as well as the forms of order and control that listening entails. Through notions and practices of improvisation and noise, attunement and audibility sonic spatiality and urban sonicity they explore, challenge and expand the structural and sensorial qualities of law. Moreover, they recognise how hearing directs us to perceiving and understanding the intrinsic acoustic sphere of simultaneous relations, which challenge and break the normative distinctions that law informs and maintains. In an attempt to hear the ambiguous, indefinable and unembodied nature of hearing, as well as its objects – sound and silence – this volume approaches hearing as both an ontological and epistemological device to think with and about law.

The limited scope of participation in the making of EU law remains a continued source of controversy, featuring prominently in recent institutional and political developments that have been shaping the EU's constitutional framework - most intensely in the follow up of the Commission's White Paper on Governance. Yet little attention has been paid to participation rights as a means of ensuring the procedural protection of persons affected by EU regulation in its diverse forms. This is a dimension of the rule of law that has been largely ignored by EU legislative and judicial bodies. Not only the legislator, but also the Court of Justice and the Court of First Instance tend to adhere to excessively formal conceptions of participation rights that are premised on the right to be heard in individual procedures, as well as to a restrictive view regarding the relationships between the citizens and the administration. This book shows why, in the face of new regulatory developments, these conceptions are currently inadequate to ensure the legal protection of rights and interests affected by EU regulation. Combining a conceptual analysis with thorough empirical scrutiny, this book assesses the scope of participation rights in EU law against their rationales and underlying legal values. It makes a case for the extension of participation rights to new situations and new types of procedures, in particular those that would generally fall within the category of rulemaking. It brings distinct normative insights into a crucial theme of EU administrative law, and makes a topical and timely contribution to the increasingly notable theme of public participation in EU regulation. Joanna Mendes' 2009 thesis upon which Participation in EU Rule-Making is based was awarded the the European University Institute (Florence) Mauro Cappelletti Prize for the best doctoral thesis using a methodology of comparative law
