Probate Court of each of the counties through which the road may pass, who shall file and preserve the same; and when so deposited and filed, said road shall be considered established as a territorial road, to all intents and purposes, and shall be opened and kept in repair, as other territorial roads in this territory are opened and kept in repair. SEC. 4. Said commissioners, and the necessary hands employed in locating said road, shall each be entitled to receive as a compensation for his services, three dollars per day, for the time necessarily employed in locating the same, to be paid out of any moneys in the treasury of theTerritory not otherwise appropriated. SEC. 5. This act to take effect, and be in force, from and after its passage. Passed the Council, January 6th, 1851. Passed the House of Representatives, January 11th, 1851. AN ACT, to create and organize Lane County. SECTIoN 1. Be it enacted by the Legislative Assembly of the Territory of Oregon, That all that portion of Oregon Territory, lying south of Linn county, and south of so much of Benton county as is east of Umpqua county, be, and the same is hereby created and organized into a separate county, by the name of Lane county. SEC. 2. Be it further enacted, That all the Territory within the said boundaries, shall compose a county for civil and military purposes, and shall be subject to the same laws, rules, regulations, and restrictions, as all other counties in the Territory of Oregon, and entitled to elect the same county officers as other counties are entitled to elect.
