Most existing theoretical approaches to industrial relations and human resources management (IR/HRM) build their analyses and policy prescriptions on one of two foundational assumptions. They assume either that conflict between workers and employers is the natural and inevitable state of affairs; or that under normal circumstances, cooperation is what employers can and should expect from workers. By contrast, A New Theory of Industrial Relations: People, Markets and Organizations after Neoliberalism proposes a theoretical framework for IR/HRM that treats the existence of conflict or cooperation at work as an outcome that needs to be explained rather than an initial presupposition. By identifying the social and organizational roots of reasoned, positively chosen cooperation at work, this framework shows what is needed to construct a genuinely consensual form of capitalism. In broader terms, the book offers a critical theory of the governance of work under capitalism. ‘The governance of work’ refers to the structures of incentives and sanctions, authority, accountability and direct and representative participation within and beyond the workplace by which decisions about the content, conditions and remuneration of work are made, applied, challenged and revised. The most basic proposition made in the book is that work will be consensual—and, hence, that employees will actively and willingly cooperate with the implementation of organizational plans and strategies—when the governance of work is substantively legitimate. Although stable configurations of economic and organizational structures are possible in the context of a bare procedural legitimacy, it is only where work relationships are recognized as right and just that positive forms of cooperation will occur. The analytic purpose of the theory is to specify the conditions under which substantive legitimacy will arise. Drawing in particular on the work of Alan Fox, Robert Cox and Jürgen Habermas, the book argues that whether workers fight against, tolerate or willingly accept the web of relationships that constitutes the organization depends on the interplay between three empirically variable factors: the objective day-to-day experience of incentives, constraints and obligations at work; the subjective understanding of work as a social relationship; and the formal institutional structure of policies, rules and practices by which relationships at work are governed.

In the UK, women's economic empowerment through employment is a success story of the last three decades. And yet women are over-represented in low-paid, insecure jobs, are under-represented in top jobs, and earn less than men on average, with a marked income gap over the lifecourse. When Labour took office in 1997, a new wave of women MPs entered parliament in record numbers, and women gained access to ministerial roles, including a newly-created minister for women. However, policy on women and employment remained an area of conflict. New rights were secured, particularly for mothers, but when Labour left office a sizeable policy agenda remained unfinished. Using documentary evidence and interviews from leading policy actors from the period, Women and Employment in Public Policy takes as its starting point the Women and Work Commission, which was convened in 2004 to examine causes of the gender pay gap. The commission was unable to defuse conflicts over equal pay but it set out an agenda for change at the level of government, private-sector work organizations, and public-sector organizations. Milner examines why the commission could not resolve key conflicts, and why its broad-based recommendations were only partially taken up. She traces the subsequent development of policy, observing well-established preferences for 'light-touch' regulation which can raise awareness but leave entrenched practices unchallenged, and weaken individual women's access to redress. Detailed study of the working of the commission provides lessons on the policy process, particularly for those seeking to influence policy. It also shows that within the wider policy space, opportunities for action to effect change are possible - based on appeals to instrumental logic or political exchange - but are constrained by party leadership.

The formerly communist countries of Central and Eastern Europe (CEE) have witnessed a profound transformation of their labour laws since the 1990s and, especially, after their accession to the European Union. Today, in comparison to the other Member States, they continue to have weak trade unions and employers’ associations and an underdeveloped system of collective bargaining. Moreover, the recent economic and financial crisis highlighted the need to invest further efforts in bringing the CEE industrial relations closer to the ‘old’ Member States, in order to facilitate a more meaningful enforcement of the EU-wide economic and social policies. This is the first book to scrutinise this important matter in depth. Focusing on four current CEE labour law regimes – in Slovenia, Slovakia, the Czech Republic, and Poland – that also have different collective bargaining trends and can be said to exemplify some of the main legal and institutional frameworks for collective bargaining that the CEE countries have developed, the author addresses the following major issues: – the transition from a centralised to an open market economy and the degree of continuing residual characteristics; – the extent to which labour laws since the 1990s have enabled an adequate institutionalisation of industrial relations to allow free and voluntary collective bargaining at the national, sectoral, and company levels; and – the effectiveness of the standard-setting role of trade unions and employers’ associations insofar as they have persisted or come into play.
