Until the contrary is proven, the first applicant is considered as the originator. Persons not residing in Austria are only entitled to the grant of patents when they have appointed a representa tive (attorney) residing in the country. Joint inventors may obtain a joint pat ent, the relative rights of the parties being subject to the provisions of the Civil Code, the right to permit other parties to use the invention in doubtful cases is reserved to all the patentees jointly, although auv one of the joint patentees may prosecute infringers in the courts.
