The authors of this new EPIN paper argue for a thorough reappraisal of flexibility as an instrument of integration and outline the conditions under which it would help the enlarged European Union to move forward. In particular, treaty-based 'enhanced cooperation' should be regarded as a useful tool that avoids many of the potentially disintegrating effects of purely intergovernmental approaches. In a Union of soon-to-be 27 members, enhanced cooperation could turn the idea of flexible integration from a measure of threat to a real opportunity for deeper integration.
One of the most dynamic areas of EU law since the great changes brought to the EU constitutional order by the Amsterdam Treaty in 1999 has been cooperation in the fields of policing and criminal justice. Both fields have already been the subject of substantial legislative effort in the EU and an increasing amount of judicial activity in the European Court of Justice. In 2007 - after the Constitutional Treaty of 2004 failed - the new Reform Treaty planned very substantive changes to these policies. Bringing together a wide-ranging set of topics and contributors, this book enables readers to understand these changes by examining three key questions: how did we get to the Reform Treaty; what have been - and still are - the key struggles in competence; and how do the changes fit into the transformation of police and judicial cooperation in criminal matters in the EU?
This book presents a critical legal perspective on the current direction of EU food regulation. Analysing three regulatory mechanisms - mutual recognition, scientific risk regulation and standardisation - in the evolution of food legislation in the EU, the book shows the inadequacy of the current framework in facing the challenges of enlargement. Using the particular experience of a new member state, Poland, the book argues that an enlarged Europe must not disregard diverse socio-economic implications of market regulation. Due to historical legacies and a bias in favour of homogeneity, the EU food regulatory regime has generated a one-dimensional crisis-oriented approach. As a result, it tends to overlook other legitimate concerns such as quality, diversity and local traditions. This book argues that this need not be so.
While hedge funds have been part and parcel of the global asset management landscape for well over fifty years, it is only relatively recently that they came to prominence as one of the fastest growing and most vigorous sub-sectors of the financial services industry.
