Legal governance of disaster brings both care and punishment to the upending of daily life of place-based disasters. National states use disasters to reorganize how they govern. The collection in Disaster and Sociolegal Studies, edited by Denver University professor Susan Sterett, considers how law is implicated in disaster. The late modern expectation that states are to care for their population makes it particularly important to point out the limits to care—limits that appear less in the grand rhetoric than in the government reports, case-level decisionmaking, administrative rules, and criminalization that make up governing. These insightful essays feature leading scholars whose perspectives range across disasters around the world. Their findings point to reconsidering what states do in disaster, and how law enables and constrains action. The authors analyze sociological and legal issues surrounding disasters and catastrophic events in their many forms: natural, man-made, environmental, human, local, and global. The project was developed as part of the the Oñati Socio-legal Series supported by the Oñati International Institute for the Sociology of Law, and is now presented by Quid Pro Books in the Contemporary Society Series. Digital formats feature quality ebook formatting, active Contents, and linked chapter endnotes and URLs.

Legal governance of disaster brings both care and punishment to the upending of daily life of place-based disasters. National states use disasters to reorganize how they govern. This collection considers how law is implicated in disaster. The late modern expectation that states are to care for their population makes it particularly important to point out the limits to care - limits that appear less in the grand rhetoric than in the government reports, case-level decisionmaking, administrative rules, and criminalization that make up governing. The authors argue that government documents explaining disaster put the responsibility to adapt to rapidly changing circumstances on people - often on individuals - not on the government. Law is a causal force in what are commonly called natural disasters. When courts consider causation and property rights, often separated across cases and over time, they often defer to the importance of economic activity. Police forces charged with protection rapidly turn on those they are to protect, thinking that people need protection from the victims of disaster. These insightful essays feature leading scholars whose perspectives range across disasters around the world. Their findings point to reconsidering what states do in disaster, and how law enables and constrains action.

This paper discusses natural disaster research from agenda setting and public policy perspectives. I note the lack of such a large contribution of sociolegal research to the broader social science of disaster, and argue that there can be fruitful connections between sociolegal studies and the interdisciplinary and rapidly evolving field of disaster research. Legal scholars have a great deal to contribute to our understanding of social responses and behaviours in the face of these often-frightening events.

First published in 2001. This book provides a socio-legal analysis of disasters by setting out two sport and leisure disasters (the 1989 Hillsborough and Marchioness disasters) and considering them in their broader legal/political/economic and policy contexts. It bases the analysis on in-depth examinations of the legal responses to these disasters. The foundations for the case studies are laid by reviewing critiques of relevant contemporary legal problems. These include the concepts and contexts of disasters; the law in a liberal democracy; negligence, mass actions and policy in PTSD cases; statutory regulation of and safety; the laws of corporate reckless manslaughter and the contemporary legal problems of inquests and public inquiries into disasters. The theoretical and policy chapters are followed by the presentation of the two case study disasters, drawing on documentary sources and interviews with academics, policy makers, key legal practitioners and campaigners for legal reform, involved in these post-disaster legal processes. The analysis returns to the critical themes of the earlier chapters and ends with conclusions and recommendations for further research and legal reform arising out of this area of ‘disaster law’. Students in sport and leisure courses will be required to tackle legal and ethical issues. Law modules and courses in sport and law are developing an increasingly socio-legal, if not multi-disciplinary approach. This book takes account of this, taking a critical, multi-disciplinary approach to sport, leisure and the law. However, it will be useful to a broader group of readers who study, practice or work in the law or legal reform and apply their work to disasters.

This book puts forward a comprehensive criminology of disaster by drawing - and building - upon existing theories which attempt to explain disaster crime. Although antisocial behaviour in disasters has long been viewed as a rarity, the authors present ample evidence that a variety of crime occurs in the wake of disaster. Frailing and Harper's explorations of property crime, interpersonal violence and fraud during disaster reveal the importance of methodological approaches to understanding these phenomena. They highlight the need for the application of social disorganization, routine activity and general strain theories of crime in the development of disaster crime prevention strategies. An accessible and detailed study, this book will have particular appeal for both students and scholars of criminology, sociology, disaster studies and emergency management.

Post-disaster housing concerns and dilemmas are complex, global in nature, and are inextricably intertwined with social, economic, and political considerations. The multi-faceted nature of housing recovery requires a holistic approach that accounts for its numerous dimensions and contours that are best captured with multi-disciplinary, multi-scalar, and multi-hazard approaches. This book serves as a valuable resource by highlighting the key issues and challenges that need to be addressed with regard to post-disaster housing. By featuring a collection of case studies on various disasters that have occurred globally and written by scholars and practitioners from various disciplines, it highlights the rich diversity of approaches taken to solve post-disaster housing problems. Coming home after Disaster can serve as an essential reference for researchers and practitioners in disaster and emergency management, public administration, public policy, urban planning, sociology, anthropology, geography, economics, architecture, and other related social science fields. Key features in this book are: Addresses a wide range of dilemmas such as differential levels of social and physical vulnerability; problems related to land tenure, home-ownership, property rights, planning, and zoning; and political and legal challenges to housing recovery. Discusses the role played by public, private and non-governmental organizations, the informal sector, financial institutions, and insurance in rebuilding and housing recovery. The book outlines the regulatory environment for disaster prevention and management in broad social, economic and political context. The first half of the book focuses mainly on Japan, especially the ‘3-11’ events: the earthquake and tsunami that devastated the Tohoku area on 11 March 2011 and the Fukushima Daiichi nuclear power plant radiation leaks. The second half focuses on the USA (the only other Asia-Pacific country to have experienced a serious nuclear emergency), Indonesia, China, New Zealand, Australia and international law. One question explored is whether socio-legal norms play different roles in preventing and managing responses to natural disasters compared to ‘man-made’ disasters. Another is how ‘disaster law’ interacts with society across very diverse societies in the disaster-prone Asia-Pacific region. The book also addresses the increasingly important roles played by international law and regional regimes for cross-border cooperation in disaster prevention and relief, including the functions played by military forces. Erudite, pragmatic, and charged with detailed, substantive knowledge of an astonishing range of contexts and research fields, this timely collection of important essays on the law and society of disaster management stands as an exemplary international academic response to the disasters of 11 March 2011.
