Excerpt from United States Circuit Court of Appeals for the Ninth Circuit, Vol. 1633: 1929-1930 This plaintiff is ignorant of the true names of the defendants sued as First Doe, a corporation, Second Doe and Third Doe, and therefore designates them herein by fictitious names; and this plaintiff is informed and believes, and therefore alleges, that all of the defendants herein, and each of them, at all of the times herein mentioned were and now are citizens of the United States and residents of and in the Northern Division of the Northern District of California and within the jurisdiction of this Court. This is a suit of a civil nature arising under the Constitution and laws of the United States and jurisdiction thereof is given to this Court by Sec tions 2117 and 2124 of the Revised Statutes of the United States, and by Section 24 of the Judicial Code of the United States; and prosecution for the penalty herein claimed has been first instituted on behalf of the United States and sought wholly to their use.
